SPECIAL TERMS AND CONDITIONS FOR THE PURCHASE OF TRANSPORT SERVICES ON THE WEBSITE

These special terms and conditions for transport services govern the relationship between the service provider and passengers (customers) who book transport services through the website.

  1. GENERAL PROVISIONS

These special terms and instructions for transport services form an integral part of the contract (reservation confirmation) concluded between the provider and the customer (hereinafter referred to as the customer or passenger) who purchases or reserves transport services on the website https://booking.go-green.si/.

These special terms and instructions apply to transport services purchased via the website, organized and carried out by Ekoturizem d.o.o.

In the case of an online sale, the passenger is deemed to have accepted the provisions of these special terms and instructions for transport services when ordering the transport service online. The passenger reviews and confirms these terms and instructions on the above-mentioned website.

A customer is any person who has made a valid reservation or purchase and payment of transport services on the above-mentioned website, to whom these special terms and instructions for transport services apply.

  1. BOOKING

The customer may register/book transport services offered by GoGreen on the website. Upon registration and payment, GoGreen and the customer enter into a travel contract (reservation confirmation). The reservation confirmation received by email (to the address provided by the passenger upon booking) serves as the contract.

At the time of booking, the customer must provide all required information. If the customer provides incorrect details during the booking process, they bear full responsibility for any costs or consequences resulting from such incorrect information.

The contract (reservation confirmation) becomes valid once payment is made and the customer receives the confirmation.

The booking (confirmed and paid reservation on the website) is binding for the customer. Cancellation is only possible in accordance with the provisions on cancellation by the customer (see Section VI of these special terms).

The customer is obliged to review and read all notifications received from GoGreen. If the customer does not confirm receipt of emails, the records on our email server shall be deemed proof of receipt.

III. PAYMENT

The payment date is considered the date when the customer completes the payment on the GoGreen website (https://booking.go-green.si/).

Prices are displayed in EUR. VAT is included in all prices.

Upon reservation, the customer pays the full price of the selected transport service by credit card (Mastercard or Visa).

Timely and correctly paid fees guarantee the customer participation and a reserved seat on the selected transport service, under the conditions set out in these special terms.

At departure, the customer must present the trip manager, driver, or agency representative with proof of payment (email confirmation, voucher, or payment receipt). Otherwise, the service may be denied.

  1. PRICES

The valid prices for each ordered transport service are displayed on the website at the time of booking.

GoGreen reserves the right to increase the price no later than 20 days before the start of the transport, in case of increased costs such as transport costs (including fuel) or service charges (airports, ports, etc.) that affect the price.

Any increase is calculated proportionally to the increased cost element.

The customer may terminate the contract if the price increase exceeds 10% of the base price, in which case they are entitled to a refund of the paid amount without compensation for damages, visas, insurance, vaccinations, or similar costs.

GoGreen will inform the customer of any price changes.

Discounts and special offers are not cumulative. The customer may choose the most favorable option for which they meet the conditions.

  1. SPECIAL SERVICES

Special services are those not included in the base price.

If additional services are available, the customer must request them during booking and pay the surcharge in addition to the base transport price. Prices of such services are valid only if ordered and paid together with the transport service.

All prices are in EUR including VAT.

  1. CANCELLATION OR CHANGE OF TRANSPORT BY CUSTOMER

The customer may cancel a booked service only in writing by sending an email to: info@go-green.si.

GoGreen is entitled to reimbursement of cancellation costs depending on the time of cancellation:

  • up to 72 hours before departure: free cancellation
  • less than 72 hours to 48 hours before departure: 50% of the price
  • less than 48 hours before departure: 100% of the price

Refunds are made by the same payment method within 14 days from receipt of the written cancellation.

If the customer fails to attend without cancellation, it is considered a no-show, and no refund is granted. A ride is deemed a no-show if the customer fails to appear within 15 minutes of the agreed pickup time and location (or within 60 minutes at airports).

The customer may request a change of time, date, or location up to 48 hours before departure, in writing via email. GoGreen may charge administrative and reorganization costs and recalculate the service price. GoGreen may reject the change request if capacity is unavailable.

GoGreen is not liable for delays of flights, ships, or trains, nor for program changes resulting from such delays.

VII. PRE-DEPARTURE NOTIFICATION

Customers receive a departure notice (with driver and vehicle details) the day before departure by 14:00 CET, sent to the email address provided at booking. GoGreen customers may also verify or request the notice at info@go-green.si or by calling +386 51 303 404.

If the passenger does not receive the notice by 14:00 CET the day before the planned departure, they must notify GoGreen immediately at the above email and/or phone number, but no later than 12 hours before departure. If the customer fails to verify receipt and does not contact GoGreen, the company is not liable for any consequences (e.g., missed transport, additional costs).

If the customer provides incorrect or incomplete contact details and does not receive the notice, GoGreen is not responsible for the consequences.

If technically possible, GoGreen may send an SMS as additional assistance. However, the primary communication channel is email. Customers are responsible for regularly checking their email inbox (including spam/junk folders) and ensuring accuracy of contact information.

 

VIII. TRAVEL DOCUMENTS AND OTHER CUSTOMER OBLIGATIONS

The customer must inform themselves about valid passport, visa, customs, foreign exchange, and health regulations. They are responsible for ensuring that they and their documents and luggage comply with the applicable regulations of their own country as well as the country of travel or transit.

A customer traveling abroad must have a valid passport or other appropriate document required for entry into the destination country.

If entry is conditional on a minimum validity period of the document before expiry, the customer must comply. GoGreen assumes no responsibility for issues or forced trip interruptions arising from non-compliance.

  1. CANCELLATION BY PROVIDER

Any cancellation by the provider is considered valid. The provider may cancel the transport, in whole or in part, if circumstances arise before or during execution that could not have been avoided, foreseen, or prevented, and that would have prevented the provider from entering into the contract had they existed at the time. The provider must inform users immediately and refund all payments.

If service cannot be provided or is interrupted due to force majeure or extraordinary unforeseen events (external causes beyond control, unavoidable or unpreventable), the provider is not liable for resulting damages. Force majeure also includes terrorist acts and cyber-attacks.

  • Terrorist act means any violent act threatening human life, property, or infrastructure, committed for political, religious, ideological, or similar purposes, aimed at influencing government or intimidating the public.
  • Cyber-attack means a malicious act using or via computers, IT systems, hardware/software, databases, chips, circuits, or other devices, malware, or other electronic systems.

GoGreen may terminate the contract and seek damages from passengers who violate contractual provisions, particularly if they intentionally provide false information (e.g., number or age of passengers) or fail to report changes.

  1. SAFETY AND LIABILITY

All vehicles are licensed for passenger transport, undergo inspections, and comply with Slovenian law. Passenger accident insurance is included in the price. Vehicles are covered by TRIGLAV d.d. roadside assistance insurance.

Drivers are obligated to act responsibly toward both vehicle and passengers.

  1. DATA PROTECTION

The protection of personal data is a priority. Customer data is always safeguarded against loss, destruction, falsification, manipulation, or unauthorized disclosure, in accordance with applicable law.

The customer agrees that the provider processes all submitted and collected data in line with the Slovenian Personal Data Protection Act (ZVOP-2) and Regulation (EU) 2016/679 (GDPR).

The provider collects, uses, and processes personal data solely for the purpose of concluding and performing the contract, fulfilling obligations, and enforcing rights under the contractual relationship.

The provider may share personal data with insurance companies, state authorities, municipalities, law enforcement, courts, or other entities, as required by law.

By confirming the order, the customer acknowledges their rights under ZVOP-2 and GDPR, including inspection, copying, amendment, correction, blocking, and deletion of data.

The provider may store personal data for up to five years after fulfilling contractual obligations or until full settlement of the customer’s obligations. After that, data is deleted, destroyed, blocked, or anonymized.

Collected personal data may include:

  • passenger’s full name,
  • permanent or temporary residence,
  • age or date of birth (for children requiring appropriate car seats),
  • customer’s tax number,
  • email address,
  • phone number,
  • child’s height and weight (if required for safety seat).

The provider undertakes to process and store data securely under ZVOP-2 and GDPR and not disclose it to third parties except as explained.

By accepting these terms, the customer consents to the use of personal data by authorized third parties and for purposes such as direct marketing, market research, business analysis, customer segmentation, statistics, and promotional communication. The customer may refuse or withdraw consent at any time.

XII. TRANSPORT

Once the customer is seated, the driver begins the journey to the agreed destination. Transport is carried out with the agreed or better vehicle type.

If the address provided is not accessible with the chosen vehicle, the provider may propose an alternative or nearest accessible location.

XIII. LUGGAGE

Each passenger is entitled to one piece of hand luggage (10 kg) and one personal bag/suitcase (up to 25 kg). Additional luggage is possible if requested at least 72 hours in advance and paid extra.

Hazardous or illegal substances are strictly prohibited.

The provider is not liable for personal items lost or forgotten in the vehicle.

XIV. GENERAL RULES DURING THE RIDE

Passengers must observe the following rules:

  • No standing or walking while the vehicle is moving.
  • Seat belts must be worn where available.
  • Food and drinks are not permitted; glass containers are forbidden.
  • Smoking is strictly prohibited.
  • Luggage must be placed in designated compartments.
  • Dangerous items are prohibited.
  • Animals are not allowed without prior notice and confirmation.

The driver may deny boarding or ask a passenger to leave if they:

  • show signs of intoxication or drug use,
  • are unclean in a way that could damage the vehicle or inconvenience others,
  • behave disruptively or dangerously,
  • are injured or ill with a risk of deterioration,
  • carry hazardous, explosive, toxic, or otherwise dangerous goods,
  • carry illegal items.

In such cases, the driver must stop the vehicle, notify authorities and GoGreen (+386 51 303 404). Costs or delays caused are borne by the responsible passenger.

Preventive health measures (e.g., against infectious diseases) are applied per NIJZ recommendations.

  1. TRANSPORT OF CHILDREN

When booking for children, the customer must provide the child’s age, height, and weight, and designate an accompanying adult.

Children must use child seats in accordance with road safety regulations. Children over 3 years old but shorter than 150 cm may not travel in front seats.

The customer must ensure enough adult escorts for groups of children, per regulations. Escorts are responsible for children’s safety when boarding and exiting, as well as order in the vehicle. They must ensure all children are seated and buckled throughout the journey.

XVI. JOURNEY INTERRUPTIONS

A stop where all passengers exit the vehicle is considered an interruption. For trips up to 200 km, a stop of up to 15 minutes is planned; for longer trips, up to 30 minutes. Longer/more frequent stops are only possible with all passengers’ consent and if they do not affect arrival time.

If passengers ignore driver’s instructions or otherwise obstruct transport, the provider is not liable for delays or resulting consequences.

XVII. VEHICLE BREAKDOWN

If the trip is interrupted for reasons not caused by the passenger, they are entitled to:

  • be transported to the destination by another vehicle, or
  • be transported back to the departure point with luggage, and cancel the contract with a refund.

In case of force majeure, the above obligations do not apply.

The provider’s liability for delays or interruption is limited to double the paid service price.

XVIII. END OF TRIP

The journey ends when all passengers exit the vehicle at the final destination.

XIX. CUSTOMER LIABILITY AFTER THE TRIP

The customer is liable for any damage caused by passengers to the vehicle and must reimburse all costs (repairs, transport to service, extraordinary cleaning, etc.).

If extraordinary cleaning is required (e.g., spilled food/drink, vomit, excretions, stains, cigarette odor, animal hair), the customer must cover the additional cleaning costs.

  1. COMPLAINTS

If the customer notices deficiencies during the ride that cannot be resolved by the driver, they must immediately notify the provider at +386 51 303 404.

If unresolved on site, a written complaint must be submitted within 8 days after service completion to info@go-green.si, including customer details, a precise description, and supporting evidence.

The provider responds within 8 days and issues a final decision within 60 days. Complaints are only processed if submitted as described.

If the customer disagrees with the resolution, they may file a lawsuit before the competent court under Section XXI.

XXI. DISPUTE RESOLUTION

Transport orders concluded under these terms are governed by the law of the provider’s seat. The parties will attempt amicable settlement. Failing that, disputes fall under the jurisdiction of the competent court at the provider’s registered office.

EKOTURIZEM d.o.o. does not recognize any out-of-court consumer dispute resolution body as competent for disputes.

This derives from the Slovenian Out-of-Court Consumer Dispute Resolution Act, and Regulation (EU) No. 524/2013.

XXII. VALIDITY OF SPECIAL TERMS

These special terms apply to all contracts concluded from the date of publication on https://booking.go-green.si/.

For the customer, the terms valid at the date of booking confirmation apply.
